Advice given ref why Class 3 vehicles can be supplied zero rated when sold to an eligible disabled person:

1. Class 3 vehicles are Invalid Carriages as governed by “The Use of Invalid Carriages on Highways Regulations 1988” which can be found at: http://www.opsi.gov.uk/si/si1988/Uksi_19882268_en_1.htm

The regulations set out the requirements for the vehicles and state who may use them for this category of vehicle to apply, including “a person falling within a class of persons for whose use it was constructed or adapted, being a person suffering from some physical defect or physical disability”.

2. These products are CE marked as medical devices under the EU Medical Devices Directive. The definition of a medical device which applies to these products is for the “…alleviation of or compensation for an injury or handicap”.

This mobility scooter has been designed solely for the purpose of being used by a disabled person or a person with a chronic condition which results in the need for a disability scooter. The scooter is not designed and can not be sold for any other purpose. This is a disability vehicle and only designed for this use.
